Ingram Technologies One Year Limited Warranty

What Does This Warranty Cover?
Ingram Technologies,LLC. (The "Company") warrants to the Original Purchaser that the Company's hardware is free from defects in workmanship or material under normal use and service. This warranty commences on the date of completion of installation and tests of the hardware to the Original Purchaser.

What are the Company's Obligations Under This Warranty?
During the warranty period, the Company agrees to repair or replace the hardware, at the Company's sole option without charge to the original purchaser, or any defective component part of the hardware. To obtain service, the Original Purchaser must contact the Company by phone, mail, or E-Mail within thirty days of failure to the hardware, with the specific information about the failure. Any information that can be supplied by the Original Purchaser about the failure should be from operationg personnel of the equipment, to insure that accurate information is obtained to resolve the problem. Most problems that arise from the use of Photo Lidar are generally operator induced and can be solved with communication with the Company. At the sole option of the Company and upon receipt of the communique from the Original Purchaser, the Company will instruct the Original Purchaser either to return the defective equipment for replacement or repair, or will service the equipment "on site". If the equipment is shipped to the Company for repair or replacement, the Original Purchaser assumes responsibility and risk until the Company is in receipt of the equipment. At that time, the Company assumes the responsibility and risk to the equipment. The Original Purchaser will assume any and all shipping and insurance responsibilities for shipment to the Company. The Company will assume all responsibilities for shipping and insurance to the Original Purchaser for the return of the repaired or replaced iquipment. If a service call to the Original Purchaser's location is required and the failure of equipment id NOT from misuse or abuse of the equipment, the Company will assume the costs of the repair and replacement parts. If it is determined by the Company's service person, on the service call to the Original Purchaser's location, that the equipment was abused or misused by the Original Purchaser's personnel or damaged by other means, as described in "What The Warranty Does Not Cover" section of this document, then the Original Purchaser will assume the costs incurred by the Company, including the cost of any replaced equipment or parts, travel by service personnel, lodging and food. The Company may at it's sole option, use repaired or reconditioned or like new parts or units, when repairing any hardware. Repaired products shall carry the same amount of outstanding warranty as original equipment or ninety days, or which ever is greater. In any event, the Company's liability for defective hardware is limited to repairing or replacing the hardware at it's sole discretion.

What The Warranty Does Not Cover.
This warranty is contingent upon the proper use, storage and maintenance of the hardware by the Original Purchaser and does not cover; if damage is due to an accident; unusual physical, electrical, or electromechanical stress; heat; modification; meglect; misuse; failure of electrical power; air conditioning (moisture condensation); humidity control; water damage; wind damage; transportation; operation with media not approved by the Company; or tampering with or altering of the hardware in any way. This warranty does not cover the software purchased by the Original Purchaser from the Company.

What Is The Length Of The Warranty?
This warranty given herein, together with any implied warranties, including any warranties of fitness of use for a particular purpose, are limited to ONE YEAR from the date of installation completion and testing of the hardware.

What Are The Limits On The Company's Liability?
The Company shall not be liable to the Original Purchaser for loss of data, loss on income, lost savings, special, incidental, consequential, indirect, or other similar damages arising from breach of warranty, breach of contract, negligence, legal action.

No Liability For Consequential Damages
To the maximum extent permitted by applicable law, in no event shall The Company or it's suppliers be liable for any damages whatsoever (including without limitation, direct or indirect damages for personal injury, loss of life, loss of operations, loss of information, business interruption, loss or income, or ANY other pecuniary loss) arising out of the use of or inability to use this product, even if the Company has been advised of the possibility of such damages.

No Other Warranties
To the maximun extent permitted by applicable law, the Company and its' suppliers disclaim all other representations (written or oral), warranties, conditions or other terms either expressed or implied, including but not limited to implied warranties and/or conditions of merchantability and fitness for a particular purpose, with regard to the hardware and software and any accompanying written materials. This written warranty gives you specific legal rights. You may have other rights which vary from state to state.

This warranty allocates risks of the products(s) failure(s) between Original Purchaser and the Company. The Company's hardware pricing reflects this allocation of risk and the limitation of liability contained in this warranty. The warranty, set forth above is in lieu of all other expressed warranties, whether written or oral. The agents, employees, distributors and dealers of the Company are NOT authorized to make modifications to this warranty, or additional warranties binding on the Company. Accordingly, additional statemants such as dealer advertising, or presentations, whether written or oral, do not constitute warranties by the company and should not be relied upon.
